Frequently Asked Questions

Q:

If I already filed a claim but have haven not been paid, can you take over the claim on my behalf?

A:

We can take over at any stage of the process and pursue your claim until it is paid in full.

Q:

What type of claims do you handle?

A:

We evaluate all claims if there has been an economic loss because of the BP Oil Spill.  Whether you are an individual that has lost $1,000.00 spent on a vacation or $10 million lost because of an interruption to your business, we will evaluate and pursue your claim if you become a client.  You should call immediately to have your claim evaluated.

Q:

How soon will my BP claim be filed if I sign up?

A:

Once you become a client and we have collected all of your information, the claim will be filed immediately.  The sooner we can submit a claim on your behalf, the sooner you are likely to get compensated for your losses.

Q:

What kind of claims are being paid by BP?

A:

A wide variety of claims are being considered for payment by BP.  If you have suffered an economic loss because of the oil spill, you have a right to recover from BP.

Q:

What happens if BP refuses to pay my claim or is not willing to pay enough?

A:

If BP is not willing to pay every penny that is owed, you will still have the right to file a lawsuit and seek recovery.

Q:

What kind of damages can I recover?

A:

Although no specific guidelines currently exist for the types of damages recoverable  by submitting a claim directly to BP, the law allows for recovery of all sums of money that have been lost as a result of the BP Oil Spill.  Such losses would include the interruption of your business, any kind of lost profits, loss of work and pay or salary, attorneys’ fees and the expenses associated with the filing of your claim.  In addition, you may be legally entitled to recover for other types of damages, including mental anguish and damages to deter or punish such conduct by BP in the future.

Q:

How much will you charge to handle my BP claim?

A:

Your consultation and case evaluation to determine whether you are eligible is free.  The Gibson Law Firm works on a contingency fee basis.  We will not get paid unless we recover funds on your behalf. Typically, a law firm will charge a 35 to 40% contingency fee to handle a lawsuit, from start to finish.  In an effort to put as much money back in your pocket, as soon as possible, we will be handling direct BP Claims on a significantly reduced contingency fee.
